INTRODUCTION

BravoSolution has subscribed to and will adhere to the EU-U.S. and Swiss-U.S. Privacy Shield Frameworks by adopting and implementing the Privacy Shield Principles (“Principles”). For the purpose of this Privacy Policy, “Personal Information” means any data relating to an identified or identifiable individual, including, for example, name, address, telephone number and e-mail address, and “processing” means any operation performed on Personal Information, such as, for example, collection, use, management, consultation or disclosure.

INFORMATION COLLECTION AND USE

The information collected by BravoSolution may be used in a number of ways. BravoSolution’s goal in collecting personal information is to provide you, the user, with the most personalized web experience possible. By knowing a little about you, BravoSolution is able to deliver more relevant content, and hence a better service, to you. From time to time, BravoSolution will send you information about our various products and services, or other products and services we feel may be of interest to you. You can remove yourself from this distribution list via a link in the communication.

BravoSolution is the sole owner of the personal information that may be collected on its public sites. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. BravoSolution may collect information from our users at several different points on our websites. For example, BravoSolution may ask for your name, email address and other personal information when you request materials on the website. BravoSolution may collect personal information from our customers and their suppliers and business partners related to the use of the software and services we provide to our customers.

As an agent (as that term is used in the Principles), we obtain and process EEA and Swiss Personal Information on behalf of and under the instructions of our customers relating to services BravoSolution provides, such as Personal Information stored by customers or their suppliers using our BravoAdvantage online offerings. In that context, customers are the data controllers or agents and the roles and responsibilities of the parties for the processing of Personal Information are defined in our agreements with our customers.

BravoSolution will not disclose any of your personal information unless when we believe in good faith that the law requires it, or to protect the rights or property of BravoSolution.

If we intend to disclose Personal Data to a third party acting as a data controller or as an agent we will comply with, and protect, Personal Information as provided in the Accountability for Onward Transfer Principle. When providing our software and services to our customers and their suppliers we may disclose Personal Information as provided in our agreement with customers.

We remain responsible for the processing of Personal Information received under the Privacy Shield and subsequently transferred to a third party acting as an agent if the agent processes such Personal Information in a manner inconsistent with the Principles, unless we prove that we are not responsible for the event giving rise to the damage.

You have a right to access the personal data that BravoSolution collects.

BravoSolution offers individuals choices and means for limiting the use and disclosure of their personal data.

COOKIES

A cookie is a piece of data stored on the user’s hard drive containing information associated with the user. We use cookies to be reminded of who you are and to access your account information (stored on our computers) in order to deliver to you a better and more personalized service. This cookie is set when you register. Cookies are also used to estimate the number of visitors to the Site. Each browser accessing BravoSolution is given a unique cookie that is then used to determine repeat usage versus initial usage.

IP ADDRESSES

We use IP addresses for purposes of system administration, and to analyze trends, administer the site, track user’s movement within the site, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

This web site may contain links to other sites. Please be aware that BravoSolution is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each and every web site that collects personally identifiable information. This privacy statement applies solely to information collected by this Web site.

SEND A PAGE – TELL A FRIEND

If a user elects to use our referral service for informing a friend about our site, we ask them for the friend’s email address. BravoSolution will automatically send the friend a one-time email inviting them to visit the site. BravoSolution stores this information for the sole purpose of sending this one-time email.

NOTIFICATION OF CHANGES

If we decide to change our privacy policy, we will post those changes so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email. Users will have a choice as to whether or not we use their information in this different manner. We will use information in accordance with the privacy policy under which the information was collected.

EU-U.S. and SWISS-U.S. PRIVACY SHIELD FRAMEWORK

BravoSolution complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. BravoSolution has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, BravoSolution commits to resolve complaints about our collection or use of your personal information.

BravoSolution is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). We may be required to disclose personal information that we handle under the Privacy Shield in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

BravoSolution has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit https://www.jamsadr.com/file-an-eu-us-privacy-shield-or-safe-harbor-claim for more information or to file a complaint. The services of JAMS are provided at no cost to you.

As outlined in Annex 1 of the Privacy Shield Framework, under certain conditions, an individual has the possibility to invoke binding arbitration for claimed violations of the Principles not resolved by any other Privacy Shield mechanism.

BravoSolution commits to cooperate with EU data protection authorities (DPAs) and comply with the advice given by such authorities with regard to human resources data transferred from the EU in the context of the employment relationship.
